It's dropped by elf wildlife, every multiple of five of each you spot in other gardens.  The tree is not complete without one, and you also can't claim the Christmas gift on Christmas day.

The one you have out has the correct belt/buttons for Santa.  It also needs a red jacket (arms), white beard (mouth) and a red Santa hat.  Elf mice and ducks only drop Santa parts.
